Regulatory

Linenhall Chambers has a team of experts with an extensive track record in both prosecution and defence of criminal regulatory cases in both the criminal and civil courts, including the Magistrates Court and Crown Court, and other tribunals.

Our experts represent individuals, professionals, businesses, local authorities, all major prosecution agencies and regulatory bodies in all aspects of regulatory and disciplinary work.

With regulation constantly increasing and businesses, professions and the professionals who work within them under higher levels of scrutiny than ever before, Linenhall Chambers are able to provide expert representation in regulatory and disciplinary matters involving but not limited to enforcement and prosecutions by the following bodies:

  • Health & Safety Executive (HSE)
  • Trading Standards (TS)
  • General Medical Council
  • General Dental Council
  • Teaching Regulation Agency
  • Environment Agency
  • Natural Resources Wales
  • Security Industry Authority

Our team holds a deep understanding of the governance and regulation of these bodies which they combine with their practical experience of the Court process to minimise stress for clients and advise on the best course of action in what is often a highly stressful situation.

In addition, our experienced team can advise on wider regulatory law matters including in relation to consumer credit, food hygiene, waste management, liquor and music licensing, disciplinary tribunals, animal welfare, police complaints, health and social care and education, judicial review and immigration and asylum.

Our barristers have extensive experience of prosecuting on behalf of regulatory bodies and local authorities across England, particularly in the North West, and Wales.

They also undertake work on a direct access basis or via an instructing solicitor for individuals and businesses where they are accused of failure to comply with the relevant regulations and standards.

They understand the career, reputational and financial consequences that such cases hold for clients and that early access to expert representation is critical when proceedings have been initiated, particularly where the matter has progressed to tribunal.

Many of our team have experience as solicitors prior to being called to the Bar and this previous experience means they are adept at representing clients in tribunal.

We are able to help clients with:

  • All forms of regulatory action and investigations, including emergency support arising from specific incidents and inspections
    Compliance, governance and policy enforcement
  • Court representation including written and oral advocacy
  • Inquests and inquiries
